457 Nomination & Visa Application
The Nomination
An
approved Standard Business Sponsor (SBS) can nominate skilled foreign
nationals to work in Australia on a temporary basis for up to 4 years.
The nomination criteria are that:
- 1.The nomination is for a position that is on the 457 Occupation List

- The
applicant will be paid the Market Salary Rate for the occupation
nominated which must be equivalent to at least the
Temporary Skilled Migration Income Threshold (TSMIT)

- The
Terms and Conditions of the employment are no less favourable than for
an Australian in an equivalent position in the same location and the
salary paid is at least at the Market Rate

Above
criteria does change from time to time and we are here to best guide
you through these changes to ensure nomination compliance and therefore
success of the application. The nominated person must meet ANZSCO
(Australian and New Zealand Classification of Occupations)
qualification and market salary rate must be equivalent or above the
TSMIT rate. We undertake research into the market salary rate and
submission thereof with the
nomination.
The Visa application A visa application for the nominee needs to be lodged and it is crucial to demonstrate that the nominee:
- Has the required skills to fill the position
- Meets the health requirements for the temporary visa and holds suitable health insurance
- Meets
the English Language requirements (IELTS test score – general module of
5 across all 4 test components of listening, reading,
writing, speaking), however some nationals and occupations are

A
457 visa has a term for up to 4 years and another 4 year extension is
possible. The nominator determines the length of the visa. The 457 visa
holder can only work for the sponsoring employer, unless a different
employer lodges a new nomination for the employee.

The visa can be cancelled if the employee stops employment for more
than 28 days. The visa holder must maintain their health insurance
cover.

applications by providing well constructed and complete
applications working of a DIAC’s check-list and adhere to
the DIAC’s preferred method of online-lodgement. Currently the
processing times are indicated between 11 and 22 days from time
of lodgement
